Abstract

This paper discusses about Shariah compliance issues in the enforcement of judgment in Islamic banking and finance in Malaysia. Though Islamic banking and finance have been practised more than 30 years in Malaysia, there are several issues which need serious attention and discussion. Such issues are riba in judgment, jurisdiction of the civil courts, qualification of the civil judges, and bindingness of the SAC rulings. The paper also provides some suggestions to improve the Shariah compliance aspect in enforcement of judgment in Islamic banking and finance industry.
